Welcome to Tong!
These Terms of Use (“Terms”) govern your use of the Tong mobile game (“Tong” or “the Game”) as distributed through the Apple App Store (iOS) and Google Play Store (Android) as a standalone app, developed and operated by Miracle Tea Studios Ltd. (“we”, “us”, or “our”).
By downloading, installing, or playing Tong on your mobile device, you agree to these Terms.

Scope

These Terms apply only to the Tong mobile app available on iOS and Android.
Tong is also available on other platforms, including CrazyGames.

When you play Tong on CrazyGames, your use of the Game is governed by these CrazyGames-specific Terms of Use, not these Terms.

Elegibility

The Game is intended for players who are 13 years of age or older. If you are under 13 years of age, you are not permitted to use the Game. During onboarding, the Game will ask you to confirm your age so that we can apply appropriate privacy settings and comply with child privacy laws, including the Children’s Online Privacy Protection Act (COPPA).

License to Use the Game

We grant you a personal, non-exclusive, non-transferable, revocable license to download and play Tong on your mobile device for your own non-commercial entertainment purposes, subject to these Terms.

Ownership and Intellectual Property

All rights, title, and interest in Tong, including all content, graphics, sounds, and code, remain the property of Miracle Tea Studios Ltd or our licensors.
You agree not to copy, modify, distribute, sell, or reverse engineer any part of the Game.

Onboarding Age Declaration & Consent

As part of the onboarding process, the Game will ask you to:

• Confirm that you are at least 13 years of age by ticking a checkbox. Users under the age of 13 are not permitted to use the Game.

• On iOS devices, a system prompt will appear requesting permission to allow tracking. This prompt is provided by Apple and determines whether personalised ads can be shown.

• On non-iOS devices, the Game will ask whether you consent to receive personalised advertisements.

You can update your personalised ad preferences at any time via the Game’s privacy settings. On iOS, this can be done through your device’s Settings.

In-Game Ads and Purchases

Tong is free to play and may display third-party advertisements via the Unity LevelPlay (IronSource) mediation platform.
We only share limited information necessary to deliver ads and improve the Game; we do not sell your personal information.
We have enabled a “Do Not Sell” option by default for all users.
Ads are shown according to your consent preferences, and you can adjust your personalised ads setting at any time in the privacy settings.

Any in-app purchases made in Tong on other platforms such as iOS or Android through the Apple App Store or Google Play Store are platform-specific, non-transferable, and non-refundable (except as required by law or by the relevant store’s policies).

User Conduct

While using Tong, you agree that you will not:

• Use Tong for any illegal, harmful, or unauthorised purpose.
• Create or share any content in Tong (including usernames, room names, or other text) that is offensive, vulgar, hateful, threatening, harassing, discriminatory, or otherwise inappropriate.
• Bully, harass, threaten, or harm other players.
• Attempt to disrupt, hack, cheat, exploit bugs, or interfere with the Game’s servers, network, or other players’ experience.
• Use bots, cheats, exploits, or unauthorised third-party tools to gain an unfair advantage.

We may suspend or terminate your access to Tong at any time if you violate these Terms or behave in a way that negatively impacts other players or the Game’s integrity.

Disclaimer and Limitation of Liability

Tong is provided “as is” without warranties of any kind.
We do not guarantee that Tong will always be secure, error-free, or available.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of Tong.

Privacy

Your privacy is important to us.
Please review our Privacy Policy to learn how we collect, use, and protect your data, including special measures for children and your consent choices.
We do not sell your personal information and have enabled a “Do Not Sell” setting by default for our ad partners.
You can review or adjust your personalised ads preference in the Game’s Privacy Settings.

Termination

We may suspend or terminate your access to Tong if you violate these Terms or misuse the Game.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Game or by other means.

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
